To Donald or rather to Donald’s legal team.

1) you were president at the time you incurred insurrection. So yes it is constitutional to be impeached.

2) nobody else is allowed to incite rebellion even if we weren’t president at the time so what makes you special?

Great to see we’ve assembled right here, in our very own corner of the dark webernets, the most astute US Constitutional legal team on the planet. WOO HOO!!

It’s straight to the Capitol for you lot. Do not pass GO, do not collect $200.

The Senate will resume tomorrow at noon (local time), when the Democrats will begin presenting their argument for convicting Trump of inciting an insurrection against the US government.

Impeachment is just the flip-side of treason.

Trump didn’t actually succeed in doing anything.

That’s not an excuse though, you can be charged for bungled crimes even if you didn’t get anything out of it.

I don’t see it that way. I think he was very successful in inciting a bunch of people to storm the capital building in an attempt to intimidate the people inside to throw out an election result.

The Senate will reconvene at 4:00 AM Sydney time, with Democrats poised to finish presenting their case for Donald Trump’s conviction with points about the harm that Trump wrought and the risks of letting him go unpunished.

It’s bound to be another historic day in a historic era, and you don’t want to deprive your future self the chance to say you watched it all unfold.

The Americans have themselves painted into a corner.

It seems that some say he can’t be impeached because he’s no longer President, but at the same time he can’t be tried as a ‘private citizen’ because he was President at the time.

You’d think he could be charged as a private citizen regardless of being the president, having him above the law would seem to go against what the USA was founded on.

>>Trump is facing criminal investigation in Georgia over election results

Earlier this morning, prosecutors in Fulton County, Georgia (home to the state’s biggest metro area of Atlanta) announced they’re launching an investigative inquiry into “attempts to influence” the Georgia election.

A controversial recording of a phone call between then-President Donald Trump and the state’s top election official, Brad Raffensperger, will be included.

“The inquiry makes Georgia the second state after New York where Mr. Trump faces a criminal investigation. And it comes in a jurisdiction where potential jurors are unlikely to be hospitable to the former president; Fulton County encompasses most of Atlanta and overwhelmingly supported President Biden in the November election,” reports the New York Times.

The timing of the inquiry can’t be overlooked: The Democrats’ arguments today are highly unlikely to persuade the necessary 17 Republican senators to join them in convicting Trump. But there’s still other avenues that Republicans and Democrats alike can pursue when it comes to trying former officials. <<

Thing is;
He didn’t want to give up being president because he’d have to go to jail but he decided to make sure he’d go to jail for attempting to rort the system and stay president.

He’s not very bright.

Mr Trump’s lawyers will have 16 hours to deliver their side of the argument after the House managers are finished.

But they said today’s video and other evidence presented by Democrats had not made the case for Mr Trump’s culpability.

“I didn’t learn anything that I didn’t already know,” lawyer Bruce Castor said.

“We know a mob breached the Capitol and wreaked havoc in the building. I’m waiting for them to connect that up to President Trump and so far, that hasn’t happened.”

> They turned their faces away and didn’t see the evidence.

More so isn’t it, the riots and deaths would unlikely to have happened without Trump encouraging them

They’re doing a good job of providing a timeline of events. The attackers were already on TV ransacking the Capitol, and Pence and his family was already being evacuated, when DT tweeted “Mike Pence didn’t have the courage to do what should have been done to protect our Country and our Constitution, giving States a chance to certify a corrected set of facts, not the fraudulent or inaccurate ones which they were asked to previously certify. USA demands the truth!”
The new footage is alarming but I think the main thing that the prosecution has done is to establish the length of time between the tart of the attack and the time when Trump ceased adding fuel to the fire.

To add a bit of perspective;
Bill Clinton was widely known to have ‘A Zipper Problem’
long before he even ran ran for the presidency the FIRST Time.
(he had a piece of crumpet on the side all while he was sill governor)
Second, it’s also a matter of degree, Monika Juwinski was a willing adult(ry)
and there’s a vast difference between diddling a spy planted to bring him down
and screwing the entire cuntry (the entire world) …why else are we disGusting it?

Q) Almost every Australian I speak to now says they wouldn’t visit America at the moment (this is assuming no COVID). Tensions are too high, and the country appears dangerous from the outside.

With your local, homegrown perspective; do you think the average American does or does not understand the damage that their global reputation has taken? I just can’t work out if it’s unawareness or indifference. -Just, why?

A) You know, I think I could write 10,000 words on this topic and still not do it justice. Maybe I’ll try some day. But very briefly — and from my own perspective — I’d say it’s a lack of awareness. Whenever I’m at political rallies and I tell strangers I cover US news for an Australian media outlet, I can almost see the wheels turning behind their eyes, like they hadn’t considered how their presence at one political event could matter to someone across the globe.

‘Australians are really interested in this?’ I get asked pretty frequently.

I couldn’t count the number of times Americans from across the political spectrum follow that up with a similar revelation, which usually sounds something like:

‘Wow, they must think America is a mess right now.’

The Department of Justice could technically pursue a case against Trump, but we haven’t seen anything to suggest this is happening. However, there’s two criminal investigations into Trump happening at the state level. One of those, in Georgia, relates to Trump pressuring an official to overturn the election results.

Lawyer David Schoen actually left the trial while Representative Ted Lieu was speaking, to do an interview with Fox News.

Mr Schoen told reporters the presentation by House impeachment managers was “offensive” and “an entertainment package”.

From the good old abc:

“This trial is about far more than President Trump. It is about silencing and banning the speech the majority does not agree with,” said Bruce Castor, one of Mr Trump’s lawyers.

“I urge you instead to look to the principles of free expression and free speech.”

• with my interjection >There was no insurrection.. but only because it failed. There was lots of free speech, like “Hang Mike Pence”.

At a break in the proceedings, Democrats said the defence argument was a “false equivalence” with their own behaviour.

“Donald Trump was warned, if you don’t stop talking about a stolen election, people will be killed,” Democratic Virginia senator Tim Kaine said.

“He was specifically warned that. He kept talking about it, and a violent mob attacked the Capitol and seven people are dead who would be alive today, had he just followed their advice. That’s what I thought about those videos.”

Emily is good with her live updates at the ABC.

This trial looks all but certain to be over in just 5 days.

The extraordinary brevity speaks to two main themes of this era of US politics:

1. The role of 24/7 cable news. There was less to parse out in this case because everyone saw the events unfold in real time. The multimedia presentations throughout the trial just reinforced how both sides could look at the same clips of speech and come away with two opposing interpretations of meaning.

2. The intensity of partisanship. Cable news also means that both sides had made up their minds about the narrative before the trial even started, in large part because their supporters had their minds made up, too, based on what sources of information they consumed.

Another key stat that reinforces all this: The Senators asked just 28 questions during this trial, according to PBS’s Lisa Desjardins. During Trump’s last trial, they asked 186.

Can the McCarthy story be submitted as evidence?

Can Trump’s call with Mc Carthy be submitted as evidence?? -Mc Carthy

I’m 92 per cent sure the answer here is no. There’s a pretty strong rule about submitting formal evidence two days before the arguments begin, and now, of course the arguments are over. There’s a small part of me hesitating because impeachment trials are rare and funky, procedure-wise. The Senate themselves set the rules of the trial and even vote to adopt them at the start of the trial.

In either case, it feels unlikely that the Democrats would even try to submit this. For one thing, it’s just one report, which has been unconfirmed by other outlets. CNN is the same organisation that reported Republican Senator Mike Lee accidentally received a call from Trump on the day of the riot. Lee disputed that account during the trial, and the Democrats just struck the reference to the fact from the record, rather than back up CNN and fight the matter.
