Most of the private enterprise in space is under contract to governments (like ferrying people/supplies to the ISS) or launching commercial satellites so I don’t have a problem with a small space tourism business on the side. Branson’s operation is the most openly commercial but I don’t think taking paying customers in low orbit is problematic. IMO I think it is inevitable that one day there will be commercial accomodation in higher orbit and see this as the precursor to such a operation.

I think so. A rocket becomes more stable in flight if the maximum amount of mass is packed as far forward into its nose as possible. Also, the diameter required to take passengers is considerably larger than the diameter that is optimum for a suborbital rocket.
