but a smartphone can secretly download data on a voice only plan and chew up your prepaid voice

If you have a fancy phone, full of apps, regardless of being data only, those apps may still want to update themselves when they updates are pushed out by the developers…

wife turns her data off except for checking weather and sometimes downloading a picture from the daughter, then turns it off again.

Just a note about the ombudsmans office, they are not a first resort and will tell you to address all of your issues first with the provider. Only after this has been done will they possibly get involved.

there is no fine print on their web site where you can chose plans
It just says Voice Only Plan

The phone doesn’t know this though, it may use the network to update things regardless, is the mobile data switched on ?

maybe data is more bandwidth hungry than voice. with multiplexing they can fit a lot of conversations on the same lines. if they get clog with people using them for continuous data they may lose revenue. and customers.
anyway your contract is for voice only so you can hardly complain.
If you are sure you have not downloaded any data then you should contact the company beginning with T.
If you actually have downloaded data (either intentionally or not) then I can’t see that you have anything to complain about.
(The conditions of service that you said you read, but didn’t really, almost certainly allow for charging rip-off prices for data on your plan).

Mobile data is off but must have been on as there was a 14 mb download
that 14 mb chewed up my $30 voice only credit

yes mobile data is off now and was off
but it should not matter if the switch is on or off
its a voice only plan
its not a voice and data plan
and its not a data plan either
I’m fed up, Ill think I will take out the sim and put it a cheap voice only phone
It seems the issue here isn’t the particulars of the plan, but more the ability of the user to adequately configure the phone’s settings so as to limit mobile data.

my gripe is that if you cannot use data credit for voice credit on a prepaid plan, then why can data credit use voice credit on a voice only plan
